"Confidential" Grand Jury Transcripts

As you can see, it got pretty heated between Dearborn County Prosecutor Aaron Negangard and me when I was before the grand jury. I have to say that he made me crack in the Dearborn County Courthouse. This confidential dialogue came from a microphone that was hidden under a disposable Dixie Cup.

Prosecutor Negangard: Daniel Brewington, did you order the Code Red?

Dan Brewington: You want answers?

Prosecutor Negangard: I think I'm entitled.

Dan Brewington: You want answers?

Prosecutor Negangard: I want the truth!

Dan Brewington: You can't handle the truth!

Dan Brewington: Aaron, we are bound by a legal system that has walls, and those walls have to be guarded by men with intelligence and honesty. Who's gonna do it? You? Your crooked court officials? I have a greater responsibility than you could possibly fathom. You weep for Dr. Edward J. Connor, and you curse people who challenge the system. You have that luxury. You have the luxury of not knowing what I know. That Dr. Connor’s professional demise, while tragic, has protected a lot of families. And my existence, while grotesque and incomprehensible to you, helps society. You don't want the truth because deep down in places you don't talk about at parties, you don’t want my integrity to go near your legal system. We use words like honor, code, law. We use these words as the backbone of a life spent defending something. You use them as a punch line. I have neither the time nor the inclination to explain myself to a man who rises and sleeps under the blanket of the very freedom that I provide, and then questions the manner in which I provide it. I would rather you just said thank you, and went on your way, Otherwise, I suggest you pick up a sign, and march against corruption in the Indiana Courts. Either way, I don't give a damn what you think you are entitled to.

Prosecutor Negangard: Did you order the Code Red?

Dan Brewington: I did the job I...

Prosecutor Negangard: Did you order the Code Red?

Dan Brewington: You're Goddamn right I did!

As many of you have figured out, this is an altered version of the courtroom dialogue from the movie “A Few Good Men”, starring Jack Nicholson, Tom Cruise, and Demi Moore. I want to apologize to most of the people who came to this blog with the expectation that they were going to find the actual dialogue from yesterday’s proceedings. I am prohibited from talking about what went on inside the grand jury hearing. I am simply trying to teach Dearborn County Prosecutor Aaron Negangard a couple of lessons. The first lesson is freedom of speech. Sometimes I like to move away from the monotony of all of my legal research and take a little time to entertain. That’s another component to freedom of speech; the ability to entertain. The second lesson is that I take life very seriously but at the same time I enjoy living life. Prosecutor Negangard is coming after me with vengeance; I’m going after (legally speaking of course) corrupted public officials because it’s the right thing to do. There is also an amusing sidebar to the situation. People appreciate how I am able to take on a corrupt Dearborn County Justice System with a smile on my face and a spring in my step. It’s not because I am crazy or dangerous as Dr. Connor would like people to believe; it’s because I am a person who takes life in stride and I am not going to let a group of criminals bring me down.

So there you have it Aaron. The jokes on you and people find it very entertaining so it falls under First Amendment Speech. Of course I probably didn’t have to tell you that. After all, you are a powerful lawyer and I only have an associate’s degree from the University of Cincinnati.

Today's follow-up letter to Dearborn County Prosecutor

On October 30, 2009, I wrote a letter to the Dearborn County Sheriff's Department and Prosecutor's Office that addressed my concerns about how Dr. Edward J. Connor willfully provided false information to the Dearborn County Courts. I also explained how Dr. Connor retaliated against me because I addressed his unethical and/or illegal conduct with government officials. Neither entity returned my correspondence so today I sent a follow-up letter to Dearborn County Prosecutor Aaron Negangard. Now Prosecutor Negangard is fully aware of Dr. Connor's fraudulent testimony and letters to the Courts because I provided Prosecutor Negangard with copies of Dr. Connor's letters and testimony. For example:
  • On September 10, 2008, Dr. Connor sent a letter to the Court stating that his office staff forgot to have me sign Dr. Connor's Office Policy Statement. Dr. Connor went on to attack me while claiming that I suffered from reality distortion because I had difficulties accepting that it didn't matter that Dr. Connor's office did not allow me to review or sign the contract because the Office Policy Statement was "simply an adjunct document to the Court Order."
  • Ten months later, Dr. Connor testified in Judge Humphrey's Court that the Office Policy Statement was NOT an "adjunct document to the Court Order," and his office staff mistakenly had the mother sign the contract.
Now, Negangard is in possession and is fully aware of the documentation demonstrating that Dr. Connor knowingly gives false evidence and testimony in the Dearborn County Courts. Mr. Negangard is currently seeking an indictment against me for Harassment and Intimidation in Dearborn County that allegedly occurred in 2007, 2008, 2009, and 2010. If Negangard is basing his charges on the statements of Dr. Edward J. Connor, then Dearborn County Prosecutor Aaron Negangard chose to ignore Dr. Connor's conduct and decided to prosecute me for publicizing Dr. Connor's actions. If Prosecutor Negangard has fully investigated my case, it would appear that Negangard wants to incarcerate me because I was persistent in questioning how Dr. Connor could file a custody evaluation report that even Dr. Connor claimed to contain "numerous errors and oversights." My letter should help the prosecutor realize that Dr. Connor is the true threat to families in Dearborn County; not Dan Brewington. If Prosecutor Negangard is pursuing Harassment and Intimidation charges against me on behalf of Dr. Connor, then Dearborn County actively retaliates against people for questioning the unethical, illegal, and sometimes dangerous conduct of public officials and their unlicensed professional experts. Feel free to check out some of the evidence against Dr. Connor that is currently in the possession of Dearborn County Prosecutor Aaron Negangard. Of course Prosecutor Negangard and the Dearborn County Court System has substantial interest in trying to prosecute me instead of Dr. Edward J. Connor. If Negangard prosecutes me, he can claim that I present a danger to society. If Negangard tried to prosecute Dr. Edward J. Connor, it would be a public relations nightmare because Negangard would to have to explain why Dearborn County was prosecuting Dearborn County's number one psychological expert.

I have received many emails in support of exposing corruption in Dearborn County. If you or someone you know has more information about the misconduct of public officials, please feel free to contact me at dan@danhelpskids.com.

No Free Speech and No Fair Trial in Dearborn County, Indiana

Five days after the state of Indiana dismissed my complaint against Dearborn County Prosecutor Aaron Negangard, Aaron Negangard sent me a notice that he was seeking indictments against me for Harassment and Intimidation. The Judge that is supposed to preside over the case is Dearborn Superior Court II Judge Sally Blankenship. My case will involve subpoenaing IP addresses, emails, browser histories, etc., and anything else related to protecting my First Amendment Rights from being infringed upon by the Dearborn County "Justice" System. Now it looks like I may face an obstacle in obtaining necessary evidence. Honorable Sally Blankenship publicly endorses the services that Midwest Data provides to the Dearborn County Court System and the Dearborn County Prosecutor's Office.

The Honorable Judge Blankenship wrote, "The Prosecutor's Office along with the Court systems have been pleased with the service we have been receiving from Midwest Data." How can I expect to have a fair hearing when the prosecutor's office and the court system actively endorse the company that I would be subject to subpoenas? If Midwest Data were to file a motion to quash a subpoena of mine, I would be going up against a company whose website has a testimonial from the judge presiding over the hearing. I'll be going against a prosecutor whose office endorses the services from Midwest Data. This doesn't even account for the fact that the Dearborn County Courts and the Dearborn County Prosecutor's Office have previous discussed their satisfaction with the services of Midwest Data. (click the above image for large view) Now, the entities that employ and endorse Midwest Data are going to be responsible for deciding what information I may subpoena from Midwest Data.

This is just another advantage that Dearborn County uses to restrict free speech and the people's right to a fair trial. If you believe in free speech, feel free to contact Dearborn County Officials to voice your concerns. You can also post comments/concerns on Dearborn Prosecutor Aaron Negangard's Facebook Page.

I am in no way suggesting that the good people of Midwest Data have engaged in any sort of unprofessional conduct. They come highly recommended by members of the community. Midwest Data offers a multitude of technical services/sales and is very gracious in giving back to the community. I am not challenging the validity of Judge Blankenship's endorsement of Midwest Data; I just question why Judge Blankenship did not inform Midwest Data that Canon 2(B) of the Indiana Rules of Judicial Conduct prohibits judges from "lend[ing] the prestige of judicial office to advance the private interest of the judge or others."

Why I will not be voting anymore.

Dear political candidates,

I am a 36 year old male with a college degree with no criminal or violent history and I am writing you and other elected officials to inform you that I probably will not be voting anymore. I have always been a socially conscience person and have participated in politics nearly all of my life. A year before I was born, my parents purchased their home and “inherited” the polling that took place in their basement from the previous owner. I used to get excited about sneaking into the basement on election days because a neighbor working the polls would show me how to vote. In 1981, elections moved out of our basement when my mother decided to run for city council. Even at an early age, I was involved in campaign fundraisers and door to door “lit drops”. I can remember being excited to vote for the first time in a presidential election in 1992. I’ve worked the polls for school levies. Unfortunately I have lost interest in voting. I have found that it doesn’t matter whom I vote for or which party I vote for because no one is interested in protecting my right to be a father. No one is interested in protecting my rights to defend my ability to be a father. I was blamed for dragging out my divorce because I questioned the ex parte communication between the judge and the custody evaluator even after the judge recused himself for violating the Indiana Code of Judicial Conduct relating to ex parte communication. I was punished because I pointed out that the court and its unlicensed psychological expert were breaking the rules. I’ve tried to reach out to both Democrat and Republican elected officials but they say there is nothing that they can do. If elected officials cannot protect my children from judicial abuse, then what’s the point of voting? Education, health care, and the economy are irrelevant issues when compared to the fact that I am not able to see my children.

On August 18, 2009, Dearborn County (IN) Circuit Judge James D. Humphrey (R) terminated all of my visitation time with my three and five year old daughters. Prior to the termination of my parenting time, I had always played an equal role in raising my children. No one accused me of ever neglecting or abusing my children or their mother. There were no reports from the police or social services. I had a spotless parenting record. The custody evaluator, Dr. Edward J. Connor, recommended that the children’s mother have full custody but I should be able to continue to care for my daughters three days a week. It was only after I requested a copy of Dr. Connor’s case file that I became a “potential” hazard to my children’s emotion well being.

If a parent doesn’t have a constitutional right to be a part of their children’s lives, they should have a constitutional right to be able to properly defend their ability to be part of their children’s lives. On August 29, 2007, Dr. Edward J. Connor released his child custody evaluation report. On February 21, 2008, Dr. Connor contacted Ripley County (IN) Circuit Judge Carl H. Taul (D) to inform Judge Taul that Dr. Connor wanted to offer additional evaluation sessions because Dr. Connor claimed that his report contained “numerous errors and oversights”.[1] Dr. Connor also stated that the parties were responsible for paying for the additional sessions to correct Dr. Connor’s “numerous errors and oversights”. When I requested a copy of Dr. Connor’s case file from his evaluation report, per Dr. Connor’s contract and Indiana law, Dr. Connor sent a letter stating that he could not release the file. When I reminded Dr. Connor that his contract stated that I was entitled to the file, Dr. Connor stated that he would be “happy” to release the file to me once he confirmed that I was representing myself. After more ex parte communication with Judge Taul, Dr. Connor stated that he “interpreted” Judge Taul’s ruling to be that I was only entitled to the evaluation report and not the case file. In a letter to Judge Taul, dated April 16, 2008, Dr. Connor stated that his contract did state that the parties were entitled to the case file but he was not going to release the file to me because I did not have a lawyer. When I brought the matter to the Court, Judge Taul stated that the “Order to the Doctor to release was to release that which he was obligated to do under Kentucky law.”[2] Judge Taul stated that he was not going to undertake ordering Dr. Connor to release Dr. Connor’s case file because Judge Taul stated he was not familiar with Kentucky law. On August 4, 2008, Dr. Connor stated in a letter that state and HIPAA laws prevented him from releasing the case file. During a hearing on November 24, 2008, Judge Taul claimed that he ruled that I was not entitled to Dr. Connor’s case file.[3] On December 5, 2008, Judge Taul recused himself from the case.

Judge James D. Humphrey took over as Special Judge after the recusal of Judge Taul. Judge Humphrey denied my ability to review Dr. Connor’s case file. Over two and a half months after the final hearings of my divorce, without warning, Judge Humphrey terminated all of my parenting time with my children based on the testimony of Dr. Edward J Connor. Prior to Judge Humphrey’s order, no one had suggested that my parenting be terminated. Judge Humphrey wrote, “According to Dr. Connor’s testimony, Husband’s writings[4] are similar to those of individuals who have committed horrendous crimes against their families.” None of these alleged writings were submitted as evidence and Judge Humphrey also wrote, “The Court is most concerned about Husband’s irrational behavior and attacks on Dr. Connor.” When Dr. Connor began providing false information as to why he would not release the case file, I developed a website to share the information. There were no reports or testimony that I had ever placed my children in any emotion or physical danger yet Judge Humphrey terminated my parenting time because I publicized the actions of the Court’s expert.

Since the termination of my parenting time, I have run into several obstacles in trying to see my children. Judge Humphrey stated that I had to undergo another mental health evaluation, Dr. Connor’s evaluation report made no mention of me being a dangerous parent, by a mental health professional that first had to be approved by the Court. Judge Humphrey claimed he did not have the jurisdiction over the matter while the case was with the Indiana Court of Appeals. Judge Humphrey decided that he did have jurisdiction after I retained a lawyer. On March 17, 2010, Judge Humphrey set a hearing for June 13, 2010, on the approval of a psychiatrist. Just five days before the June 13, 2010 hearing, Judge Humphrey recused himself. Judge Humphrey informed my lawyer that there was an ongoing investigation that pertained to me.

On October 8, 2009, I was informed by Dearborn County Special Crimes Unit Detective Mike Kreinhop that I was under investigation for my internet writings. On November 2, 2009, Detective Kreinhop, who is currently the Republican candidate for Dearborn County Sheriff, drove to my mother’s house to speak to me. Detective Kreinhop tried to convince me that it was probably better that I did not pursue Dr. Connor because it would be better if I hired a lawyer to challenge Dr. Connor’s unethical and/or illegal practices. Detective Kreinhop refused to tell me any details of the investigation unless I would agree to meet in Dearborn County for questioning. I told Detective Kreinhop that my writings spoke for themselves and people could arrest me or sue me if I did something wrong, but I made sure that Detective Kreinhop was aware that any legal action against me would not go on without a jury of my peers. I did not hear anything about the investigation until Judge Humphrey recused himself. When I sent a request to Dearborn County Prosecutor Aaron Negangard (R)[5] for the records concerning the investigation of my internet writings, Prosecutor Negangard wrote, “Pursuant to Indiana Law, Investigatory records are confidential and are not to be disclosed.”[6] When I notified Prosecutor Negangard and other elected officials about Prosecutor’s less than accurate account of the law, Prosecutor Negangard copied me to the following email:

Please be advised that Dan Brewington is currently under investigation by the Dearborn County Sheriff's department. Once he was advised of this by Judge James Humphrey who had to recuse himself from his case only recently he has attacked me or my office. [sic] I take this an effort to get me not to do my job of prosecuting those who violate the law.[sic] I assure you his efforts will not succeed. If he has violated the law then I will make every effort to prosecute him. However I will point out that this matter is still under investigation and until such time he is convicted he is presumed innocent. He is also incorrect regarding his request. He clearly asked for records pertaining to his investigation that are not to be disclosed under Indiana law. If any of you need any further information regarding this matter. Please do hesitate to contact me.[sic]

Not only did Aaron Negangard continue to claim that Indiana law prohibited the release of investigatory records, but he accused me of undermining his ability to prosecute people who violate the law and threatened to “make every effort to prosecute” me if I violate the law. All of this came after I sent documentation to Prosecutor Negangard’s office regarding Dr. Connor’s conduct. Detective Kreinhop had previously informed me that Dr. Connor’s conduct violated interstate mail and wire fraud laws.

The Indiana Court of Appeals upheld the trial court’s ruling that I was not entitled to Dr. Connor’s case file. The Appellate Court wrote, “We first note that I.C. § 31-17-2-12(c) does not require that Dr. Connor’s entire case file be provided to Daniel. All items specified by statute were provided.” Not only did the Indiana Court of Appeals state that “the investigator’s file of underlying data and reports” in I.C. § 31-17-2-12(c) did not include Dr. Connor’s case file, the Court went on to state that I was provided with all of the information from Dr. Connor’s case file that were required by statute while knowing that it would be impossible to determine if the requirements of the statute were met without releasing the file, or having a Judge review the contents of the file under camera. The Court went on to write, “During the pendency of the proceedings, Daniel posted information concerning the dissolution on his website and blog, in response to which [Wife] sought a protective order and a temporary restraining order on more than one occasion.” My wife filed only one protective/restraining order, requesting the Court to force me to take down my internet writings. After an hour long hearing, the Court denied her motion because the information was neither harassing nor harmful to her or the children. The Indiana Court of Appeals fabricated the information about the multiple filings. The Court also ruled “panel per curiam” so the names of the judges would not appear on the ruling.

Why should I vote? I talked to Republican Indiana State Senator Johnny Nugent’s office and they said there was nothing that they could do. I sent information to Democratic Indiana State Reprehensive Bob Bischoff and also met Mr. Bischoff in person but Mr. Bischoff never responded to my correspondence. I wrote to both US Senators from Indiana, Richard Luger (R) and Evan Bayh (D). Senator Lugar was kind enough to respond but stated that there was nothing he could do. Evan Bayh didn’t bother to respond. I even contacted President Barack Obama about my situation. President Obama is always preaching the importance of fathers being involved in their children’s lives. He just doesn’t want to deal with hard part of ensuring that fathers have the opportunity to fairly defend their parenting ability in a courtroom in the United States.

Elected officials do not want to get involved with fixing this problem because it is messy. The more you look at the situation, the messier it gets. Judge Humphrey’s wife was one of four advisors on the Ethics and Professionalism Committee for the Indiana Supreme Court. When I instructed people to send letters of concern to the Ethics and Professionalism Committee advisor located in Dearborn County, I became the subject of a secret investigation. Why should Heidi Humphrey be immune from getting letters of concern that pertain to her husband? The Humphrey family should have considered the possibility of a conflict of interest before the wife of a sitting judge took the role as an advisor on the Ethics and Professionalism Committee for the Indiana Supreme Court. It appears that the Committee realized that there was in fact a conflict of interest. Within a month or two of the time I encouraged people to contact the advisor for the Ethics and Professionalism Committee that was located in Dearborn County, Becky Goshorn, Ann Heimann, JoAnn Heimann, and Heidi Humphrey were replaced by a staff attorney from the Indiana Supreme Court. It appears that they were all wives of judges. The next question is did Indiana Appellate Judge Margret G. Robb preside over my appeal because she was on the Ethics and Professionalism Committee when all of the judges’ wives were removed from the committee. Dearborn County has a few ties to the higher courts in Indiana as Former Dearborn County Superior Court Judge Michael Witte was named executive secretary to the Indiana Supreme Court Disciplinary Commission this past May and Appellate Court Chief Justice John Baker is a native of Dearborn County.

Given the fact that the Indiana Appellate Court provided false information in their decision on my case, the above connections and events may seem a little suspicious. If you combine that with the fact that an IP address registered to the Indiana Supreme Court[7] is responsible for 187 hits and 33 page views on www.danhelpskids.com and has also visited www.danbrewington.blogspot.com, there definitely seems to be something wrong going on. So who do I go to? Do I appeal to the Supreme Court? It appears that they have already conducted their own investigation of my website. Should I contact law enforcement? The last time I did that, Dearborn County Prosecutor Aaron Negangard threatened to make every effort to prosecute me if I violated the law. I contacted members of the state and US congress and I was either ignored or told that there was nothing that could be done. President Barack Obama, whom preaches about fathers stepping up and playing an important role in their children’s lives, never got back with me.

That pretty much sums up why I won’t be voting anytime soon. That does not mean that I am giving up on my children or my responsibility to help other children and parents, it just means that I am giving up on my hopes that elected officials will take action to protect children and families from judicial impropriety and abuse. I will continue to face the threat of the Indiana Courts using my children as a means of extortion to pressure me into removing my web content. I will continue to face threats of prosecution from Dearborn County Prosecutor Aaron Negangard and his year-long ongoing investigation of my internet writings. I can tell you that I have published nearly 100,000 words on the internet and I have yet to be sued or arrested. Judge Humphrey ruled that the writings were not harmful to the children. If I made any threats, I would have been arrested immediately. It appears that the Indiana Courts are upset because I publicly challenged their authority and the courts continue to punish my children for my actions. The Indiana Courts refuse to allow me to have access to the evidence that was used to terminate my parenting time and the elected officials refuse to take any action. It’s always “that’s the judicial branch; I’m in a different branch of government.” I know; I took government class. Child abuse by the judicial system is still child abuse. Unfortunately elected officials turn their heads when judges abuse little children. I cannot bring myself to vote for people who turn their backs on children.

Please visit www.danbrewington.blogspot.com and www.danhelpskids.com for more information.

Sincerely,

Dan Brewington

[1] Judge Taul was the original judge in my case but later recused himself after engaging in numerous ex parte communications with Dr. Connor.

[2] Quote from the June 13, 2008 hearing on the release of Dr. Connor’s case file. Judge Taul claimed that there was an order from his Indiana court that instructed Dr. Connor to follow Kentucky law. Dr. Connor was not licensed to practice psychology in the state of Indiana. No such order is on the record.

[3] Indiana Code 31-17-2-12 states that the evaluator’s report may not be dismissed as hearsay if the investigator makes available to counsel and to any party not represented by counsel: the investigator’s file of underlying data and reports; complete texts and diagnostic reports made to the investigator; the names and addresses of all persons whom the investigator has consulted.

[4] Dr. Connor alleged in his report that he found my writings to be confusing and difficult to follow and Dr. Connor alleged that he had difficulties in understanding me because Dr. Connor claimed I had “severe” ADHD.

[5] Prosecutor Aaron Negangard also heads the Dearborn County Special Crimes Unit. The Special Crimes Unit was designed to investigate serious crimes such as murder and drug trafficking.

Happy 7th Birthday. Daddy wishes he could be there

My daughter Mary turns seven today and I still can't see her and her sister. I still have a long hard battle in front of me because no one will let me see the evidence behind the court's findings that I have the potential to cause harm to my children. How does a father prove that he is not a potential danger to his children? I have a flawless parenting record, I've never been accused of abusing or neglecting my daughters, and during the course of a 2 1/2 year divorce, no one tried to modify or restrict my parenting time.

Judge Humphrey took away my children because he said that I may have the potential to harm them. He referred to Dr. Connor's testimony but wouldn't allow me to see Dr. Connor's records. How can I prove that I won't do something bad in the future; especially when there is no evidence that I did anything wrong in the first place? Dr. Connor testified that he thought that I "may" begin to coach my children against their mother. He was allowed to say these kinds of things and I had no way to dispute them. For some reason the fact that I never did these things was not sufficient to prove that I wouldn't do them in the future.

My ex wanted me out of my daughters' lives so she and Dr. Connor entered into different contracts and then used them to obstruct my access to evidence. When I questioned it, they attacked me. They claimed that the contract was the normal contract that was signed at the beginning of custody evaluations. Dr. Connor claimed that I couldn’t understand his policies no matter how many times he explained it to me. At the last minute, they said, "Oops, it was a mistake. Our bad" and then they claimed that I was paranoid because I felt they conspired against me. Dr. Connor said crazy things like my writings were similar to those of individuals who commit horrendous crimes against their families. My ex claimed that I became so verbally abusive that she had to take the children into the bathroom, lock the door, and run water in the tub and sing songs to the girls to block out the yelling. How do you refute lies like that? Bring in an FBI profiler to study my writings? If my ex was that afraid of me, why didn't she call 911? She didn't have any problems having me arrested for calling the girls on the phone, which was in line with the Indiana Parenting Time Guidelines. Better yet, she told her story as if the locked bathroom door protected her and the children from terrible harm. As responsible parents, we always kept a key for the bathroom door handy in case the girls would lock themselves in. If her story was true, why wouldn’t I have unlocked the door? The better question is, if I was verbally abusive to the children or around the children, why was there no mention of my daughters ever being afraid or uncomfortable with me. In fact, Dr. Connor’s report stated that the girls were very comfortable with me and that I had excellent parenting skills. This is what I have to fight against. First they claimed that I didn't take the children to the doctor and then turned around and said that the only reason I took them to the doctor was to try to act like a primary parent. My ex said that the girls were not safe sleeping on the second floor at my house because I didn't properly block the steps. After I moved both of the girls' beds into my 15' x 25' bedroom and double gated the doorway, she expressed "concerns" about the girls' sleeping arrangements, but no one wanted to elaborate on what the "concerns" consisted of because there could be severe legal ramifications for "those kinds" of false accusations. When my ex claimed that I left firearms lying around the house after she filed for divorce, I bought a gun safe and moved my guns from the locked closet to the safe. Then I was accused of only getting the safe to appease her and she even listed the safe as a marital asset. In 2005, my ex called the police because she said I wouldn't let her leave with our daughter. When the police arrived, they made her leave, alone. When this was brought up in court, she and Dr. Connor claimed that the police officer, who is now the Sheriff of Ripley County, didn't ask her for her side of the story. When I received help from my mother during the divorce, they claimed I dumped my children on my mother. When my ex received help from her parents, they claimed it was necessary in order to help her out during the tough divorce. All of my "problems" were attributed to my "severe" ADHD. All of her problems were attributed to my "severe" ADHD. They said I did not take responsibility for my actions. They claimed that I was responsible for her problems. Now I have to overcome all of this without having access to the evidence that "supports" the allegations against me.

Here's my dilemma, for some reason showing up in court and demonstrating that I have never done any of the things that they say that I might do, is not a valid defense. No one ever claimed that I ever brought harm to my children; they just claimed that I "might" do it in the future. How long do I have to continue not harming or harassing people before a judge will determine that I am not going to begin to do the bad things that people are claiming that I “might” do? I don’t need a psychological evaluation; I need a fortune teller because I need someone who will testify that, in the future, I continue to conduct myself in a responsible and law abiding manner. Maybe by the time my daughters turn 18, people will realize that I have never nor will I ever do anything to hurt my children or anyone else. The people who are hurting my children are the people who are preventing my daughters from spending birthdays and holidays with their father. Happy 7th Birthday Mary. I’m still the kind and loving father that I was before the mean people took your daddy away. For more history on my story, go to www.danhelpskids.com.

"Serpico"; and how the good guys are somehow the bad guys

Last night I watched the 1973 film “Serpico” starring Al Pacino. “Serpico is based on a true story about an honest New York police officer, Frank Serpico, who blew the whistle on widespread police corruption. Serpico did not set out to bring down bad cops; the bad cops turned on him when he would not accept bribes and payoffs. Serpico’s actions in standing up to crooked officials in the police department and city government only got him labeled as a “bad cop.” When nobody in the system would do anything about rampant police corruption, Frank went to the newspaper. Shortly after the New York Times published a front page story about the corruption in the New York City Police Department, Serpico was sent to the dangerous ranks of the narcotics unit where he was shot in the face by a drug dealer while his fellow officers did nothing. Luckily Frank Serpico survived the incident and it brought forth sweeping reform to the department. Unfortunately, Serpico was still seen as a traitor amongst other police officers and received little recognition from the New York City Police Department for his bravery.

How can government spiral so far out of control to the point where the “majority rules” mentality kicks in and decides that if the bad guys outnumber the good guys, then the bad guys are right? “Serpico” is somewhat of a metaphor for government corruption on many different levels. I can liken it to my experiences in dealing with the Indiana Court System. One thing I feel that I share with Frank Serpico is a public perception of naivety. If individuals stand up against government corruption and civil rights violations in matters which the majority perceives to be impossible, the individuals are often labeled as being naïve. If the “naïve” individuals start asking too many questions, they are considered to be a threat. If the “threatening” individuals’ persistence begins to attract the ear of the public, then they are deemed dangerous. “Dangerous” is a label that dishonest officials place on people who pose a serious risk to their convenient unethical and/or illegal activity. In three simple steps, the new naïve guy in the system can somehow evolve into a danger to society. Corrupted officials need to label their opponents as being dangerous because it provides a means of justification to take almost any action necessary to eliminate the danger.

“You can’t beat the system.” I’ve heard that many times during the course of my dealings with the Indiana Court System and Dearborn County Law Enforcement. What people fail to understand is that I’m not trying to beat anything. I just want to be able to exercise all of my rights guaranteed to me by the US Constitution and I want those who are in a position to enforce the law to OBEY the laws they swore to protect. I was punished because I questioned the ethics of the Court’s expert, Dr. Edward J Connor. I was punished because I got Judge Carl H Taul to recuse himself because he violated the Indiana Judicial Code of Conduct by communicating with Dr. Connor outside the presence of the parties. I was punished for publicly writing about Dr. Connor and Judge Taul’s unethical/illegal conduct. Then I was punished for being persistent in trying to obtain the evidence against me. When I continued to question the system, I became the subject of a “secret” investigation by the Dearborn County Special Crimes Unit. When I began to request public records pertaining to the secret investigation and Judge James D. Humphrey, Dearborn County Prosecutor Aaron Negangard sent me an email where Mr. Negangard threatened to “make every effort to prosecute” me if I break any laws. Why is the Dearborn County Prosecutor threatening me? Is he threatening me because he believes I am dangerous, or is he threatening me because I am naïve? I guess it depends on what side of good or bad Mr. Negangard falls on.

Frank Serpico left the New York City Police Department after recovering from a gunshot wound to the face. The New York Times did an article on Mr. Serpico earlier this year. Frank Serpico was a victim of the NYPD yet he was viewed as a villain by many in the NYPD. The only thing Mr. Serpico was guilty of was failing to distinguish the difference between the criminals on the street and the criminals on the police force. Frank Serpico’s “inability” to differentiate the “good” criminals from the “bad” criminals prematurely ended his law enforcement career. In the January article by the New York Times, Frank Serpico said, “They took the job I loved most. I just wanted to be a cop and they took it away from me.” In a sense, I feel that I can relate to Mr. Serpico. Why should a person be punished because other people are angry that the person follows the law? I haven’t broken any laws in Indiana yet Indiana treats me as if I am a criminal. Indiana took the job I loved most. I just wanted to be a dad, and Indiana took it away from me.

For some reason, the Dearborn County Surveyor is involved in my case.

You heard that correctly. Dearborn County Surveyor Dennis Kraus sent a message to other Dearborn County officials, complaining about the attention that is being given to the circumstances revolving around Dearborn County's perpetual investigation of my writings. I sent Mr. Kraus an email addressing his concerns. It's insulting that Mr. Kraus suggests that the "common" citizen is not smart enough nor qualified to question government officials. Here is a copy of my email to Dearborn County Surveyor Dennis Kraus that includes a copy of his message to his "fellow elected officials." Mr. Kraus claims that most people aren't qualified to understand or question the actions of the government. I hope Mr. Kraus isn't going to mind being subpoenaed in a future legal hearing to determine why Dearborn County Law Enforcement felt the need to consult with the county surveyor about the confidential investigation of my internet writings.

Dear Mr. Kraus,

RE: Response to your message to “Fellow Elected Officials” (below):

Fellow Elected Officials,

While I was not copied on the attachments, I believe we should leave it up to the sheriff, prosecutor, and the judge who will decide the matter when and if it goes to court. Anything involving Federal Funding will be determined by the Federal Government, not County Officials outside of the department seeking said funding. All that these accusations from people do is distract us from our business that we are constitutionally bound to do. I am tired of all the bulls**t accusations people make and expect any and all county officials to get involved. I am a County Surveyor and this is none of my business. Beside that, (and I am not trying to insult anyone) most of us do not have the education or training to make a determination on whether or not a law has been broken that will affect Federal Funding.

Dennis A. Kraus Jr.
Dearborn County Surveyor

I would like to apologize for not copying you to the email regarding my concerns about Aaron Negangard’s conduct and how it has the potential to jeopardize future federal funding and I wanted to take an opportunity to further explain the logic behind my statements.

You are correct in stating that federal funding is determined by the federal government, but by no means are federal grants guaranteed. Federal grants are available through a form of application process and are subject to stipulations and limitations. If the appropriate federal agencies that are responsible for appropriating federal grant monies become aware that the grant money may have been used in an unethical or illegal manner, it would certainly jeopardize the ability to renew/receive such grants.

You claim that “most of us do not have the education or training to make a determination on whether or not a law has been broken that will affect federal funding.” If formal education and training were a prerequisite for questioning the conduct and decisions of government officials, then most of us would not be “qualified” to raise questions about universal health care, taxes, federal court decisions, etc… because the majority of us are not doctors, accountants, or lawyers. It appears that your contention is that the general public is not smart enough to comprehend many matters that come before government officials and that the general population lacks the experience and/or education necessary to voice their opinions; which is very offensive to the blue collar workers of the United States as it suggests that the hard working, “below upper class” workers in the United States are some kind of second rate citizens.

As you claim that you are the County Surveyor and none of this is your business, I have to question why you are writing about the situation. As you are the County Surveyor who was not copied to my original email, it should be questioned why someone felt that it was necessary to contact the County Surveyor about the situation. It also should be questioned why the County Surveyor is offering a public statement on a criminal investigation that has nothing to do with the surveyor’s office. I find it very troubling how you claim that the abilities of Dearborn County officials, to properly perform their “constitutionally bound” duties in serving the people of Dearborn County, is somehow hindered by people exercising their constitutionally protected First Amendment Rights to free speech; which was established long before Dearborn County even existed.

I am truly sorry that you are “tired of all the bulls**t accusations people make and expect any and all county officials to get involved.” I find your statement to be both insensitive and condescending. When the public’s safety is compromised, they have the ability to go to local law enforcement and/or the local prosecutor. When the conduct of the prosecutor and law enforcement are in question, it is unclear whom the public has to turn to. I’m sorry that you think that it is “bulls**t” that I told several Dearborn County officials that Prosecutor Negangard did not tell the truth in his denial of my public records request. Mr. Negangard stated, “Pursuant to Indiana Law, Investigatory records are confidential and are not to be disclosed.” Though I do not have the legal education and experience that you personally would require someone to have in order to question a county prosecutor, I do have the ability to read and Indiana Law states that all Investigatory records are subject to release at the discretion of the public agency (provided that they do not contain medical information, trade secrets, educational information, etc… in which case the specific information can be redacted or omitted.) If your comment “bulls**t accusations” refers to my statements regarding the ex parte communication between Judge James D. Humphrey and Aaron Negangard, or someone else in the prosecutor’s office and/or sheriff’s department, I can assure that they are neither “bulls**t” nor “accusations” as Mr. Negangard confirmed that someone shared some of the “confidential” information from the Investigatory record with Judge Humphrey in an ex parte fashion. This conduct disqualifies Judge Humphrey and Aaron Negangard from playing any role in charging and/or prosecuting me.

The question still remains; why are you commenting about a situation that you claim is none of your business while admitting that you do not have the education or training necessary to understand the situation? From a legal perspective, you have no basis for calling the accusations “bulls**t” because it would be impossible for you to have any information refuting the accusations; unless of course Mr. Negangard has leaked information from the Investigatory record to you or someone else. Considering that Mr. Negangard claimed that Indiana Law prohibited the release of Investigatory records because the records are confidential, one may consider it to be “bulls**t” that someone in the prosecutor’s office and/or the sheriff’s department allowed information from the “confidential” Investigatory record to spread all of the way to the office of the Dearborn County Surveyor.

Please feel free to hold county officials like Aaron Negangard responsible for their unethical actions. If you need any further information regarding this matter, please do not hesitate to contact me. Thank you for your time.

Very truly yours,

Dan Brewington

Amended Complaint against Dearborn County Prosecutor Aaron Negangard

The following is a copy of the amended complaint against Dearborn Prosecutor Aaron Negangard that I filed with the Indiana Supreme Court Disciplinary Commission. I filed the complaint after Mr. Negangard knowingly provided me with false information pertaining to the laws governing the release of public records and then attacked and threatened me after I questioned why he gave me misleading information.

Re: Amended Complaint against Indiana Attorney Aaron Negangard

Dear Members of the Commission:

I filed a complaint with the Commission against Dearborn County Prosecutor Aaron Negangard on June 16, 2010. The complaint dealt with Mr. Negangard ordering the Dearborn County Special Crimes Unit to conduct an investigation of my written (internet) material where I publicly criticized the actions of a few professionals associated with the Southeastern Indiana Court System. Since the filing of the complaint, I believe that Mr. Negangard has conducted himself in an unethical and/or illegal manner.

On July 6, 2010, I sent a public records request (copy attached hereto) to Dearborn County Prosecutor Aaron Negangard and Dearborn County Sheriff David Lusby, requesting the information pertaining to the investigation of my writings, which began around October of 2009. At the time of my July 6th request, I did not know if the investigation was still pending. In a letter dated July 7, 2010 (copy attached hereto), Mr. Negangard denied my request for the records. Mr. Negangard’s letter stated:

Dear Mr. Brewington,

Regarding your request for public records dated July 6, 2010, it is clearly requesting investigatory records. Pursuant to Indiana Law, Investigatory records are confidential and are not to be disclosed.

I have enclosed a copy of the statue [sic] for your review.

Mr. Negangard highlighted a portion of the Indiana Code on page two of his attachment. The highlighted section reads:

[IC 5-14-3-4(b)(1)] Investigatory records of law enforcement agencies. However, certain law enforcement records must be made available for inspection and copying as provided in section 5 [IC 5-14-3-5] of this chapter.

I found Mr. Negangard’s denial to be rather disturbing because he stated, “Pursuant to Indiana Law, Investigatory records are confidential and are not to be disclosed”, however just above the section that Mr. Negangard highlighted, the Indiana Code reads:

[IC 5-14-3-4(b)] Except as otherwise provided by subsection (a), the following records shall be excepted from section 3 of this chapter at the discretion of a public agency

After reading section (b) of IC 5-14-3-4, I was concerned about Mr. Negangard’s statement because it did not appear that Indiana Law prohibited the release of Investigatory records. When I researched the matter, I came across The Indianapolis Star vs. The Trustees of Indiana University, May 2, 2003, which states:

“Section 4 [of IC 5-14-3] in turn sets forth several exceptions to the disclosure requirements of section 3. Ind. Code §5-14-3-4 (Burns Code Ed. Supp. 2002). Section 4(a) sets forth mandatory exceptions to public access, and section 4(b) sets forth exceptions which may be invoked at the discretion of the public agency.”

When I discovered that Indiana Law actually states that all Investigatory records are subjected to release at the discretion of the public agency, provided that the records do not fall under section 4(a), I addressed the issue in a letter dated July 12, 2010 that I copied to Mr. Negangard. Given the suspicious nature of the “investigation” of my public writings that criticized county officials and Mr. Negangard’s less than honest reasoning for the denial of my public record request, at 10:43:36 AM, I emailed copies of the letter to other county officials to make them aware of the situation. I wanted to alert county officials about the conduct of Mr. Negangard because if Mr. Negangard used the resources of the Dearborn County Special Crimes Unit in the course of unethical and/or illegal behavior, Dearborn County could be in jeopardy of losing state and federal grants relating to law enforcement. At 4:46 PM on July 12, 2010, Mr. Negangard sent the following email to fifteen (15) county officials [copy of Mr. Negangard’s email attached hereto]. Mr. Negangard also copied me to his threatening email. Mr. Negangard’s email states:

To all county officials:

Please be advised that Dan Brewington is currently under investigation by the Dearborn County Sheriff's department. Once he was advised of this by Judge James Humphrey who had to recuse himself from his case only recently he has attacked me or my office. I take this an effort to get me not to do my job of prosecuting those who violate the law. I assure you his efforts will not succeed. Please do hesitate to contact me. [sic]

Before Mr. Negangard’s July 12th email, I was not aware that there was still a pending investigation of me. I question why Mr. Negangard felt that it was necessary to tell (15) county officials that I am under investigation by the Dearborn County Sheriff’s Department[1]. I find it very troubling that Mr. Negangard shared the details of an ongoing investigation with Judge James D. Humphrey when he claimed that the release of Investigatory records was prohibited by Indiana Law. Rather than address the fact that he provided me with inaccurate information about the laws governing the release of public records, Mr. Negangard claimed that my letter questioning his interpretation of laws “was an effort to get [Mr. Negangard] not to do [his] job of prosecuting those who violate the law.” Not only did Mr. Negangard accuse me of trying to undermine his ability to prosecute criminals in Dearborn County, Mr. Negangard vowed to “make every effort to prosecute” me if I broke the law. It appears that Mr. Negangard and/or the Dearborn County Sheriff’s Department are conducting a perpetual investigation of my web writings in the hope that they will be able to “catch” me doing something illegal so that Mr. Negangard can “make every effort to prosecute” me.

I feel that Dearborn County Prosecutor Aaron Negangard continues to persecute me because he cannot prosecute me. I have been very outspoken about my concerns about the Dearborn County Court System and I feel I have been harassed for doing so. Mr. Negangard has waged a smear campaign against me because I questioned his judgment and has threatened me with criminal prosecution if I step out of line. Mr. Negangard has yet to explain why he told me that Indiana Law prohibits the release of Investigatory records when it clearly does not. As Mr. Negangard has admitted to speaking to at least one Dearborn County judge about the situation, I fear that I may not have a fair opportunity to request a court to compel Mr. Negangard to release the records because Mr. Negangard could have spoken to other judges about the matter as well. It is frightening to imagine the civil rights atrocities that may have been committed in Dearborn County if Prosecutor Negangard regularly engages in ex parte communications with judges about ongoing investigations before charges are filed and before matters are sent to court. A person convicted of a crime would have no way of knowing if Mr. Negangard discussed their case with a judge before there were even any charges filed. If I do file an action in a trial court, I fear I may be further attacked or retaliated against by Mr. Negangard. Mr. Negangard’s threatening email suggests that the ongoing investigation of me will only end “if” I do something wrong.

I welcome the Commission to check my criminal record as I have no history of criminal or menacing behavior. I feel I have been victimized by Mr. Negangard for exercising my First Amendment Rights to free speech. If I presented a real danger to Dearborn County citizens, why hasn’t Mr. Negangard brought charges against me during the course of the nine month investigation? Why is Aaron Negangard telling the public that I am innocent until I am convicted when he has yet to file any charges and he refuses to tell, at least me, what I may be convicted of? I am afraid that Mr. Negangard may be retaliating against me for filing the complaint and for pointing out to county officials that he was less that truthful in his denial of my public record request.

I would like to thank the Commission for their attention to this matter.

Respectfully,

Daniel P. Brewington
