"Confidential" Grand Jury Transcripts

As you can see, it got pretty heated between Dearborn County Prosecutor Aaron Negangard and me when I was before the grand jury. I have to say that he made me crack in the Dearborn County Courthouse. This confidential dialogue came from a microphone that was hidden under a disposable Dixie Cup.

Prosecutor Negangard: Daniel Brewington, did you order the Code Red?

Dan Brewington: You want answers?

Prosecutor Negangard: I think I'm entitled.

Dan Brewington: You want answers?

Prosecutor Negangard: I want the truth!

Dan Brewington: You can't handle the truth!

Dan Brewington: Aaron, we are bound by a legal system that has walls, and those walls have to be guarded by men with intelligence and honesty. Who's gonna do it? You? Your crooked court officials? I have a greater responsibility than you could possibly fathom. You weep for Dr. Edward J. Connor, and you curse people who challenge the system. You have that luxury. You have the luxury of not knowing what I know. That Dr. Connor’s professional demise, while tragic, has protected a lot of families. And my existence, while grotesque and incomprehensible to you, helps society. You don't want the truth because deep down in places you don't talk about at parties, you don’t want my integrity to go near your legal system. We use words like honor, code, law. We use these words as the backbone of a life spent defending something. You use them as a punch line. I have neither the time nor the inclination to explain myself to a man who rises and sleeps under the blanket of the very freedom that I provide, and then questions the manner in which I provide it. I would rather you just said thank you, and went on your way, Otherwise, I suggest you pick up a sign, and march against corruption in the Indiana Courts. Either way, I don't give a damn what you think you are entitled to.

Prosecutor Negangard: Did you order the Code Red?

Dan Brewington: I did the job I...

Prosecutor Negangard: Did you order the Code Red?

Dan Brewington: You're Goddamn right I did!

As many of you have figured out, this is an altered version of the courtroom dialogue from the movie “A Few Good Men”, starring Jack Nicholson, Tom Cruise, and Demi Moore. I want to apologize to most of the people who came to this blog with the expectation that they were going to find the actual dialogue from yesterday’s proceedings. I am prohibited from talking about what went on inside the grand jury hearing. I am simply trying to teach Dearborn County Prosecutor Aaron Negangard a couple of lessons. The first lesson is freedom of speech. Sometimes I like to move away from the monotony of all of my legal research and take a little time to entertain. That’s another component to freedom of speech; the ability to entertain. The second lesson is that I take life very seriously but at the same time I enjoy living life. Prosecutor Negangard is coming after me with vengeance; I’m going after (legally speaking of course) corrupted public officials because it’s the right thing to do. There is also an amusing sidebar to the situation. People appreciate how I am able to take on a corrupt Dearborn County Justice System with a smile on my face and a spring in my step. It’s not because I am crazy or dangerous as Dr. Connor would like people to believe; it’s because I am a person who takes life in stride and I am not going to let a group of criminals bring me down.

So there you have it Aaron. The jokes on you and people find it very entertaining so it falls under First Amendment Speech. Of course I probably didn’t have to tell you that. After all, you are a powerful lawyer and I only have an associate’s degree from the University of Cincinnati.

Today's follow-up letter to Dearborn County Prosecutor

On October 30, 2009, I wrote a letter to the Dearborn County Sheriff's Department and Prosecutor's Office that addressed my concerns about how Dr. Edward J. Connor willfully provided false information to the Dearborn County Courts. I also explained how Dr. Connor retaliated against me because I addressed his unethical and/or illegal conduct with government officials. Neither entity returned my correspondence so today I sent a follow-up letter to Dearborn County Prosecutor Aaron Negangard. Now Prosecutor Negangard is fully aware of Dr. Connor's fraudulent testimony and letters to the Courts because I provided Prosecutor Negangard with copies of Dr. Connor's letters and testimony. For example:
  • On September 10, 2008, Dr. Connor sent a letter to the Court stating that his office staff forgot to have me sign Dr. Connor's Office Policy Statement. Dr. Connor went on to attack me while claiming that I suffered from reality distortion because I had difficulties accepting that it didn't matter that Dr. Connor's office did not allow me to review or sign the contract because the Office Policy Statement was "simply an adjunct document to the Court Order."
  • Ten months later, Dr. Connor testified in Judge Humphrey's Court that the Office Policy Statement was NOT an "adjunct document to the Court Order," and his office staff mistakenly had the mother sign the contract.
Now, Negangard is in possession and is fully aware of the documentation demonstrating that Dr. Connor knowingly gives false evidence and testimony in the Dearborn County Courts. Mr. Negangard is currently seeking an indictment against me for Harassment and Intimidation in Dearborn County that allegedly occurred in 2007, 2008, 2009, and 2010. If Negangard is basing his charges on the statements of Dr. Edward J. Connor, then Dearborn County Prosecutor Aaron Negangard chose to ignore Dr. Connor's conduct and decided to prosecute me for publicizing Dr. Connor's actions. If Prosecutor Negangard has fully investigated my case, it would appear that Negangard wants to incarcerate me because I was persistent in questioning how Dr. Connor could file a custody evaluation report that even Dr. Connor claimed to contain "numerous errors and oversights." My letter should help the prosecutor realize that Dr. Connor is the true threat to families in Dearborn County; not Dan Brewington. If Prosecutor Negangard is pursuing Harassment and Intimidation charges against me on behalf of Dr. Connor, then Dearborn County actively retaliates against people for questioning the unethical, illegal, and sometimes dangerous conduct of public officials and their unlicensed professional experts. Feel free to check out some of the evidence against Dr. Connor that is currently in the possession of Dearborn County Prosecutor Aaron Negangard. Of course Prosecutor Negangard and the Dearborn County Court System has substantial interest in trying to prosecute me instead of Dr. Edward J. Connor. If Negangard prosecutes me, he can claim that I present a danger to society. If Negangard tried to prosecute Dr. Edward J. Connor, it would be a public relations nightmare because Negangard would to have to explain why Dearborn County was prosecuting Dearborn County's number one psychological expert.

I have received many emails in support of exposing corruption in Dearborn County. If you or someone you know has more information about the misconduct of public officials, please feel free to contact me at dan@danhelpskids.com.

Dearborn County wants a new jail so they have room to lock me up.

Well, not exactly just for me but while Dearborn County Prosecutor Aaron Negangard is on his witch hunt to prosecute me for my internet writings, Dearborn County Sheriff Mike Kreinhop is parading local media through the current jail explaining how a new Dearborn County jail must be built to handle overcrowding. Eagle News 99.3 posted a video of Kreinhop's prison tour on YouTube.com. Kreinhop was the person who first contacted me about my "writings" on October 8, 2009. [listen to Sheriff Kreinhop's voicmail] Nearly a year and a half later, Prosecutor Negangard is seeking charges for alleged harassment and intimidation that allegedly occurred in Dearborn County in 2007, 2008, 2009, and 2010. I really didn't have anything to do with Dearborn County until 2009. It was in May of 2009 where I recorded Dearborn County Police Officers harassing me in the Dearborn County Courthouse. Now while complaining about jail overcrowding, Dearborn County is willing to build extra space for people they want to censor.

Why haven't I seen my kids for over a year? This is why.

Many people question why I haven’t had the opportunity to see my children for over a year now. The reason is Judge James D. Humphrey did not want me to see my children and Judge Humphrey actively worked to prohibit me from being able to get back with my children. The following is an explanation of why/how I haven’t even had an opportunity to comply with Judge Humphrey’s orders so I can see my daughters.

In the final decree of my divorce, filed August 18, 2009, Judge James D. Humphrey wrote:

“Respondent shall not be entitled to visitation until he undergoes a mental health evaluation with a Mental Health Care Provider approved by the Court. The purpose of this evaluation is to determine if he is a possible danger to the children, Wife, and/or himself. Further, Husband shall follow all recommendations made by the Mental Health Care Provider.”

In the summer of 2007, I participated in a child custody evaluation that was performed by Dr. Edward J Connor. Connor’s evaluation, addendum, and psychological testing made no mention of me presenting any danger to children, Wife, and/or myself. Despite Dr. Connor reporting in his evaluation report that he had no concerns about me being a “potential danger” to anyone, Judge Humphrey terminated my ability to see my children until he received a “second opinion” from a different mental health professional confirming that I do not present a risk to anyone. If Judge Humphrey, my ex-wife, or Dr. Connor felt that my mental health presented a danger to anyone, then why didn’t they attempt to review my records from the Affinity Center in Montgomery, Ohio? Judge Humphrey, Dr. Connor, and my ex-wife were well aware that I had been under the care of a doctor and therapist for ADHD at the Affinity Center since January 2002. Despite knowing that I was (and still am) currently under the care of a doctor and a therapist for ADHD, Judge Humphrey ordered me seek an evaluation from another professional and ordered me to follow all of the recommendations rather than consult with my treating therapist and doctor. [An important thing to note here is that we are talking about Attention Deficit Disorder. If anyone can provide me with information relating to ADHD causing people to become dangerous or violent, please let me know.]

On the surface, it doesn’t look so bad. People think, “So what? Just go through an evaluation.” I can’t. First I have to have a mental health provider approved by the Court before I present an evaluation to the Court. On September 8, 2009, I filed a petition for contempt when my ex-wife stopped letting me talk to my children on the phone. Judge Humphrey set a hearing for the matter but later dismissed the hearing citing that he didn’t have jurisdiction over the case while it was in appeal. On January 19, 2010, I filed a motion to release Dr. Connor’s case file to a psychiatrist in order for me to be evaluated. Judge Humphrey denied my motion because he claimed he did not have jurisdiction. On March 11, 2010, my lawyer filed a motion to approve a psychiatrist and Judge Humphrey determined that he did have jurisdiction of the case and set a hearing on the matter for June 13, 2010. My attorney had to petition the Court to set a hearing because my ex-wife did not think that the psychiatrist that I chose was qualified to evaluate me. Judge Humphrey made me wait three months for a hearing just to approve a psychiatrist. Just five days before the hearing, Judge Humphrey recused himself claiming that there was an ongoing investigation of me that pertained to him but Judge Humphrey refused to provide any details of the alleged investigation.

Following Judge Humphrey’s recusal, the matter went back to the original judge in the case, Judge Carl H. Taul, where Judge Taul arbitrarily appointed Judge John Westhafer, of Decatur County, to serve as the Judge in my case. Since Judge Taul did not follow the rules of his own court in appointing Judge Westhafer, my lawyer file a motion to correct error. Judge Taul wasn’t allowed to just arbitrarily pick who he wanted to be the next judge; he was supposed to name a panel of three judges, giving the parties an opportunity to strike two judges from the list. On July 9, 2010, Judge Taul named Judges Cleary, Todd, and Coy. My attorney had the first opportunity to strike from the panel. Considering Judge Cleary is in Dearborn County, there wasn’t much of a debate who we didn’t want to be judge. On July, 26, 2010, opposing counsel struck Judge Coy from the list leaving Judge Todd of Jefferson County. The Ripley Circuit Court did not issue an order naming Judge Todd until August 17, 2010. Judge Todd accepted the selection of Special Judge on September 3, 2010, but the Ripley County Clerk did not mail it out until September 8th.

Nobody involved in this matter, except for my attorney and me, cares about my children. The people involved just want to keep putting off the inevitable; an outside professional appearing in court and stating that there is nothing in my history or psychological makeup that would suggest that I am a danger to anyone. Now that there is a new Judge, I can petition the Court to set a hearing to approve a psychiatrist. This is what I am required to do per Judge Humphrey’s orders. If the Court approves my psychiatrist, then I can go through an evaluation and then I have to petition the Court to set a hearing to approve the evaluation. If the Court approves the psychiatrist’s findings that I do not present a danger to anyone, I still can’t resume normal parenting. I have to find another mental health professional to observe me during two, two hour supervised visitation sessions a week with my daughters in a “therapeutic environment.” Before I can undergo supervised visitation in a therapeutic environment, I have to petition the court to set a hearing to approve the mental health professional. If the Court approves the mental health professional, I may see my children for two hours, two times a week. After I undergo supervised visitation with my children in a “therapeutic environment” and the mental health professional says that I do not present an emotional or physical risk to the children, then I can petition the Court to set a hearing to approve the findings of the mental health professional and I can request unsupervised visitation with my children. If the Court approves the findings, I can have unsupervised visitation with my children granted that I meet a list of guidelines, one of which is take down my internet content regarding the whole situation. Judge Humphrey wrote, “Because of the potential danger to the children, [Dan Brewington] must remove all postings created by him from the internet concerning the children before any unsupervised visitation may commence and/or continue.” [Please note all of the “if’s” and “approve’s”. If the Court were not to approve any of the above, I would have to repeat the step. Judge Humphrey made it clear that I am responsible for paying for all evaluations, supervised visitation sessions, etc… that are “necessary” in getting back to my children.]

None of this is about the safety or welfare of my children. It’s about protecting the people who hurt two little girls because the people hated what the girls’ father stood for. Judge James D. Humphrey was mad at me because he couldn’t force me to take down my internet content. At no point was there ever any testimony or evidence that my internet content presented any danger to the children. On April 29, 2009, Judge Humphrey held a hearing on my ex-wife’s motion for protective order requesting the Court to prohibit me from posting my experiences on the internet and requested that the Court to order me to remove my prior internet writings. On May 14, 2009, Judge Humphrey properly denied her motion because my writings were not harassing to Wife and they were not dangerous to the children. If my internet writings were truly dangerous, they would be dangerous regardless of whether or not I had unsupervised visitation with my kids. Judge Humphrey was not concerned that the children would read the internet content while in the care of their father because the children were only three and five years of age and had not even attended kindergarten. Judge Humphrey used my children as a means of extortion to try to censor me. Judge James D. Humphrey doesn’t like the fact that I call him an abuser of children. He could sue me for saying that if it isn’t true.

Nobody in the system cares about my children. If they were concerned about the safety of my daughters, wouldn’t they want the next evaluator to have the information that Dr. Connor used? Judge Humphrey denied my request to appoint a guardian ad litem to represent the children. No one requested my mental health records from the Affinity Center because they did not want outside professionals to be aware of the actions of Dr. Connor and Judge Humphrey. Judge Humphrey, Dr. Connor, and my ex-wife acted as if I manipulated and misled the people who have treated me for ADHD so they aren’t qualified to determine if I present a “potential danger” to society. Why would I spend that much time and money in trying to manipulate my treating professionals when I was the one who voluntarily sought treatment for some issues regarding concentration and organization? Dr. Connor never mentioned any “concerns” about my stability until I began requesting a copy of his case file. Dr. Connor even testified, that if the Court would order another evaluation, “whoever would be appointed to conduct the evaluation, I think they should be forewarned of what he will do if you do not agree with him or if you see things differently than he does. I think this person should be warned and not go blind into an evaluation with Mr. Brewington.” Basically, Dr. Connor claims that I should not be entitled to an unbiased evaluation. Dr. Connor wants to tell the evaluator what a bad person I am and then have me work out of the hole.

So I will keep fighting. Rather than find reasons why my children should not be fatherless, these people are spending a great deal of time and money trying to find reasons why my daughters should not have a dad. The problem that the professionals and my ex-wife have is they will have two little girls to answer to when they ask why they didn’t get to see their dad for over a year. Why should I be responsible for telling them? I think Judge James D. Humphrey should have to tell them the truth. Judge Humphrey can tell my daughters, “I know that your dad was a very loving and caring father and that he never caused you any emotional or physical pain, but we had to keep him away from you for over a year just to make sure that he wouldn’t hurt you. Now we are absolutely sure that he won’t hurt you. No thanks needed girls; it’s all part of the job in protecting children in Dearborn County, Indiana."

Update on custody dilemma.

I received an email from my lawyer yesterday that said my ex-wife was not in agreement with my choice of the mental health provider to do the court ordered mental health evaluation of yours truly. Dearborn Circuit Judge James D. Humphrey said I had to undergo a mental health evaluation before I can see my children to determine if I am a danger to my children, their mother, and/or myself. The catch is, the evaluator has to be approved by the court. My lawyer filed a motion in March to set the matter for a hearing and Judge Humphrey set the hearing for June 14th. In an attempt to expedite the matter so I can see my children, my lawyer asked my ex-wife if she would be in agreement with the psychiatrist that I chose. Of course, she did not agree to it, so I have to wait until the June 14th hearing. I guess we will have to be prepared to argue why a psychiatrist with 30+ years of experience is qualified to evaluate me. My proposed expert is not a psychologist, like Dr. Edward J. Connor, but a psychiatrist which means he is a medical doctor and is more qualified to comment on medications, make pharmaceutical recommendations and he can write prescriptions; unlike Dr. Connor.

The woman who had me arrested for calling my children on the phone is now trying to stall my court ordered mental health evaluation by challenging the psychiatrist that I chose. This is the same woman who had her lawyer submit a bogus document from Dr. Connor’s office to obstruct my access to Dr. Connor’s case file. Maybe the fact that the psychiatrist served on hospital ethics committees was what kept her from agreeing to let him evaluate me. I’ve been accused of scheming, plotting, and smooth-talking people so maybe they thought that I found a psychiatrist that would lie for me and say that I did not present a danger to anyone. Maybe they thought I used my Jedi Mind powers to trick the psychiatrist, as opposing counsel, Angela Loechel, already questioned me about the Jedi Mind Trick while I was on the stand. (That is not a joke. I have the transcripts.) Maybe my psychiatrist does not adhere to the same standards as my ex-wife’s expert, Dr. Connor who facts seem to change like the colors of the leaves in the fall. For example:

“With regard to the Office Policy Statement, we do not have a signed Office Policy Statement for you on file. It appears you were not provided with this document when you initially came to our office, which was an oversight on the part of the office staff. Nevertheless, the Office Policy Statement is simply an adjunct document to the Court order in which you and Ms. Brewington agreed to participate fully in a custody evaluation to be conducted at this office.” -Dr. Connor’s letter dated September 9, 2008 which Dr. Connor copied to the court.

Dr. Connor: There are no other forms for a custody evaluation. But there was a form that was incorrectly given to Ms. Brewington from our secretary at the time, who is no longer with us. But the basic custody forms—

Dan Brewington: But that—that form [Office Policy Statement] is an adjunct document to a court order?

Dr. Connor: No.

-A little later, Dr. Connor testified to the following:

Dan Brewington: Yes, but is that office policy statement an adjunct document to the court order?

Dr. Connor: I’m not sure what you mean by this.

Dan Brewington: Well, I’m not sure, either. You wrote it.

Dr. Connor: It’s an adjunct -- it’s not an adjunct to a court order. It’s -- it’s adjacent to what we do when people come it. They fill out the forms for the evaluation to participate in.

-Dr. Connor’s testimony during the final hearing on May 27, 2009. Dr. Connor’s testimony indicates that he either maliciously provided false information to the Court or Dr. Connor’s competency should be questioned because he is unaware of his own policies.

Sooner or later the time is going to come when a professional is going to testify that there is nothing wrong with me and it is a travesty that my children were denied the ability to see their father based on the ever-changing “facts” of Dr. Edward J. Connor and Connor and Associates, PLLC. I find it rather ironic that the people who claim that I have communication problems and claim that my writings are confusing and difficult to follow, are the same people who claim I smooth talk people. They are also the ones who submit my internet writings in an effort to make an argument that making people aware of Dr. Connor’s unethical conduct is dangerous to my children. If my writings are confusing and difficult to follow, who in the hell would take the time to read them?

The longer my children go without a father only serves to expand the void they will carry in their lives. My ex-wife fought to make an argument that I was dangerous and now she is fighting to prevent me from proving that I am not. She did the same when her attorney submitted the bogus document from Dr. Connor’s office in their efforts to obstruct my access to evidence. The longer I go without doing anything dangerous only further demonstrates that I am not dangerous. I have made it 36 years without being a danger to society, why do I need to spend thousands of dollars on mental health professionals to verify that my streak is not in jeopardy of ending anytime soon? I cannot comprehend why some people want to punish my children in an effort to punish me. I do know that the longer I have to fight for my daughters, the more they will love their daddy in the end. I love you girls. Daddy will never give up on you. For more information, go to www.DanHelpsKids.com.

Dr. Edward J Connor appointed to evaluate the "Dexter" Killer

In late November 2009 near Rising Sun, Indiana, Andrew Conley, 17, confessed to law enforcement officials that he killed his ten year old brother . Conley told prosecutors he had fantasized since the eighth grade about beating someone to death and modeled himself after television serial killer "Dexter."

This is a horrible tragedy for the family of the two boys and the surrounding community. Emotion runs rampant in cases like these. Law enforcement officials reported that Conley showed no emotion when he confessed to strangling his ten year old brother. Conley told officials that he wanted to be like Dexter Morgan, the serial killer played by Michael C Hall in the Showtime series "Dexter." Dearborn/Ohio County Prosecutor Aaron Negangard put it bluntly, "He's a cold blooded murderer."

I would assume that there is no handbook on how to handle situations tragedies like this. The legal system is set up to protect the rights of the accused as well as the victims. There have to be evaluations, competency hearings, etc... to ensure there is a fair trial. Even though Conley confessed to killing his brother, if the trial is not handled properly, it could lead to unnecessary appeals and even mistrials. The Court has a responsibility to protect the rights of the accused no matter how guilty the accused may be. Who was one of the first professionals the Court appointed to evaluate Andrew Conley? Dr. Edward J Connor of Connor and Associates, PLLC.

"This Court is most concerned about Husband's irrational behavior and attacks on Dr. Connor." Judge James D Humphrey wrote this in the final decree in my divorce. Judge Humphrey terminated my ability to see my children because he was most concerned about my "irrational behavior and attacks on Dr. Connor." Why does Judge Humphrey find it necessary to protect the professional he often appoints? The only thing I did is question why Dr. Connor lied about why Dr. Connor would not release the case file from the child custody evaluation he performed during the course of my divorce hearing. Dr. Connor attacked me when I questioned his false statements. (For more information go to When Psychologists Attack on my website) Judge James D Humphrey denied my motion to appoint a guardian ad litem (GAL) to represent my children in the divorce. If Judge Humphrey was truly concerned about the welfare of my little girls, he would have appointed a GAL to protect them. Judge Humphrey denied my motion because he did not want another professional to find out how Judge Humphrey turned his back to the unethical and illegal conduct of Dr. Edward J Connor.

In a letter to my former attorney, dated November 11, 2009, Dr. Connor attached orders that Dr. Connor claimed prohibited him from releasing the case file from my evaluation. The fax heading on the orders that Dr. Connor sent my attorney, indicated that he received the orders from Judge James D Humphrey and opposing counsel Angela G Loechel. The orders were faxed from the Circuit Court and Ms. Loechel's office to Dr. Connor's office on October 22, 2009. Neither I nor my attorney at the time were copied to any of the correspondence between Dr. Connor, the Court and opposing counsel. I later found out that none of the correspondence was on the chronological case summary, which documents the case history. If Dr. Connor would not have sent my former attorney documents with the Court's fax heading at the top, there would have been no way that I would have known Judge Humphrey was communicating with Dr. Connor without my knowledge. Communication outside the presence of the parties is called ex parte communication. Judge Humphrey's actions are a violation of Judicial Canon 3 of the Indiana Judicial Code of Conduct. Why is Judge James D Humphrey conducting ex parte communications with Dr. Edward J Connor about my case? Are they talking about other cases as well. How often do they speak off of the Court record? How much money does Dr. Connor make off his appointments from Judge Humphrey? Are Dr. Connor and Judge Humphrey going to talk about Andrew Conley's case behind closed doors?

"[Dr. Connor] attributed Mullikin's addiction to child pornography to being sexually confused after becoming aroused while being spanked by a nun in fifth grade." -Jim Hannah, www.nky.com 1/13/2010

Dr. Connor testified for the defense of Kenneth Mullikin who was found guilty of possessing "sadistic and masochistic" child pornography. What will Dr. Connor testify to for the defense of Andrew Conley? Will Dr. Connor tell the truth? Will Dr. Connor conveniently blame all of Andrew Conley's problems on a TV show or possibly a spanking from a 5th grade teacher? Judge James D Humphrey and Prosecutor Aaron Negangard are aware that Dr. Connor lied in documents provided to the Court. They are aware that Dr. Connor made false written statements concerning his business practice and his involvement in a legal hearing. Judge Humphrey and Aaron Negangard are aware that Dr. Connor sent these documents via fax and US Mail, which Detective Mike Kreinhop, of the Dearborn County Special Crimes Unit said was a federal offense. Judge James D Humphrey protects Dr. Connor's illegal conduct; Prosecutor Negangard and the Dearborn County Special Crimes Unit turns their backs.

This year is an election year for Judge Humphrey. Why would Judge Humphrey appoint a psychologist that he knows is unethical? Because this is Judge Humphrey's guy. Judge Humphrey has been appointing Dr. Edward J Connor as a psychological expert long before Dr. Connor was licensed to practice psychology by the state of Indiana. Dr. Connor's "professional opinion" can mean the difference between Andrew Conley being eligible for parole in 20 years verses never being for eligible parole. Given the history of Judge Humphrey and Dr. Connor, they may already have decided which way to go.

Dr Edward J Connor may be a Pervert

Something is very wrong here. Dr. Edward J Connor conducted a custody evaluation during my divorce. At the beginning of the evaluation, I signed a document stating that I was entitled to the case file from the evaluation report. From there, Dr. Connor stated I was not entitled to the file; I was entitled to the file; there were court orders that prevented me from having the file; he wouldn't release the file because I was representing myself; there were HIPAA laws that prevented him from releasing the file; and recently he claimed that I already had the file.

I've had quite a few men and women, who have been involved with Dr. Connor, contact me through my website and blog. I do not assume everyone who is upset with Dr. Connor are right or wrong but I do have to question how so many people have similar disturbing stories of Dr. Connor's actions. The most disturbing of which are Dr. Connor's detailed and explicit questions to the females in the evaluations about their sex lives.

Why does Dr. Connor ask women detailed questions about their sex lives. Why doesn't he ask the men? How fair could a custody evaluation be if men, by default, are suspects of sexual deviant behavior? I am not aware if these questions were asked to my ex-wife. Why don't I know; because Dr. Edward J Connor fought, kicked and, screamed not to release the case file to me. I know Dr. Connor is hiding something. Maybe he doesn't want people to know that he enjoys asking sexually explicit questions to nervous women during a custody evaluation.

If Dr. Connor does conduct evaluations with women this way, he is nothing more than a sexual predator. Dr. Connor abuses his power and punishes people who question him and the worst abuse of power is submitting people to uncomfortable sexual questions in a vulnerable environment. If the questions are necessary to determine the safety of the children, why doesn't Dr. Connor ask men about the sexual activities of the mothers? Maybe because it isn't as sexy.

This is probably one of the most disturbing issues I have come across in my dealings with Dr. Connor. Profiting from custody evaluations while exploiting children is disgraceful; using the evaluations as a means to gain some kind of perverted sexual stimulation by asking the children's mothers explicit questions about their sex lives is unthinkable. How do you make it stop? If someone raises the issue, Dr. Connor attacks them. Dr. Connor accuses people of being paranoid and suffering from reality distortion. The Judge takes away your kids. You are left with nothing because you spoke out as a victim. That's why I do what I do. They took away my little girls so my main job in life is to work to get my children back and to hold people accountable for criminal conduct.

Judge James D. Humphrey has worked with Dr. Connor for some time. Kimberly Schmaltz, current Magistrate in the Dearborn County Circuit Court, used to serve as a guardian ad litem and worked closely with Dr. Edward J Connor in "protecting" children. Prosecutor Aaron Negangard is aware of a lot of Dr. Connor's conduct. Why don't they do anything to protect children from Dr. Connor? Maybe they are golfing buddies, or cousins, or maybe someone is getting kickbacks. Maybe the situation is so grave, that everyone keeps putting off the inevitable because they know that the fall of Dr. Connor will bring catastrophic consequences due to Dr. Connor's involvement in so many civil and criminal cases. The fear of rocking the boat is never an excuse not to right the ship. It may take some time, but honesty and virtue will prevail and the officials who continue to turn their backs on Dr. Edward J Connor, and the people who protect Dr. Connor, will have to take responsibility and protect children and parents who are abused by officials like Judge James D Humphrey and Dr. Edward J Connor.

Using Technological Warfare to Battle the Family Court System

I wrote this post in response to a post on The Angry Dad, a blog by another father who is trying to bring awareness to the problems of the family court system but it was too long to post as a response.

One of the most frightening things in the world is public scrutiny. If you conduct yourself in an honest and dignified manner, you should not have anything to worry about. Divorce is bad for children. False accusations against parents are even worse. How many parents would rethink false accusations if they knew the public would have the evidence, or lack thereof, to debunk the accusations?

You want to talk public record? Let's talk public record. Final Decrees in divorces are public record. The final decree in my divorce says that I am potentially dangerous to my children so I need seek a psychological evaluation to determine if I am a safe parent. I cared for my children for half the time during a 2.5 year divorce. There were no allegations of abuse, neglect, domestic violence, the children not loving me, etc... My Ex never tried to modify parenting time. Judge James D. Humphrey terminated my parenting time with my children based mainly on the psychological testing and child custody evaluation performed by an unlicensed psychologist. When I requested the case file, which I am entitled to per the evaluator's contract, AND because it's my health record, AND because the evaluation is considered hearsay if the parties are not provided the evaluator's case file per Indiana Code 31-17-2-12. The first Judge, Carl H Taul, said he wasn't going to order the release of the file because he was not aware of Kentucky law. Dr. Edward J Connor Psy D is licensed in Kentucky. After Judge Taul recused himself following several ex parte communications with Dr. Connor, Judge Humphrey would not order the release of the case file citing that he felt that I would release confidential information. They denied my access to the evidence against me because I presented some kind of "potential risk." They did not even seal the file because it would have been an appealable matter. Then they built on the "potential risk" argument in the final hearing to the point that it might be dangerous to the children. Judge Humphrey wrote, "The Court is most concerned about Husband’s irrational behavior and attacks on Dr. Connor." Ironically, there is no evidence of any this "irrational" behavior on record despite all of my correspondence with Dr. Connor being in writing. The language of the state law uses the word "attack" in describing the process of discrediting a witness. If Judge Humphrey felt that I was such a risk, why did he deny my motion for a GAL? Why did he wait 2.5 months after the final hearing to terminate my parenting time?

Judge Humphrey wrote in the Final Decree, "Husband has posted information about the dissolution proceeding on his website, on his blog, and on various other sites, and continued to post information even after the hearing for a temporary restraining order wherein the Court's Order stated that the "Court may also consider evidence presented at this hearing regarding the temporary restraining order in regard to the Court's decision as to visitation and custody and how Respondent's actions my affect the best interest of the children now and in the future." What the Judge fails to mention was my Ex filed a motion for a temporary restraining order to have me take down my internet content because she claimed it was harmful to the children and the Judge denied it. The Court denied her request for the Court to force me to take down my internet content because it was not harmful to the children yet Judge Humphrey used my "non-harmful" actions against me in taking away my children.

The main point that gets lost in the argument is that if the judges would do their jobs, there would be no reason to publicize the issue. I would much rather be spending time with my children than sitting behind a computer but I feel I am setting a positive example for my children. Rather than resigning to being an estranged father, I am taking positive public measures to address the problem.

“The limits of tyrants are prescribed by the endurance of those whom they oppose.” -Frederick Douglass. The British Army thought the colonial "rebels" were barbaric because they hid in trees with their coonskin caps and shot at the British Army marching in formation. England was mad because they never face a foe like that before. The Courts cannot fight a battle on the internet; they can only try to keep us away from it. "To Keyboards!" (I would yell "to arms" but someone would make the argument in court that I was encouraging militant action. That's an example of fine line we have to walk.)

Officials who may be aware of Dr. Connor's Conduct

I have been emailing educators, officials, and organizations in Kentucky and Indiana. These are some of the organizations that may have visited my website www.DanHelpsKids.com and may have seen some of the unethical conduct of Dr. Edward J Connor.

The Children's Home of Northern Kentucky- Dr. Edward J Connor Psy D oversees the psychological staff at CHNK.

The Office of the Kentucky Attorney General- Jack Conway's office represents the Kentucky Board of Examiners of Psychology. At one point, Assistant Attorney General Mark Brengelman withheld a hard copy of a complaint against Dr. Connor from the Board, thus prolonging the time it took to investigate the matter.

The Kentucky Board of Examiners of Psychology- The Board has been aware of Dr. Connor's unethical conduct for some time now, yet the Board did not find Dr. Connor's actions to be any "apparent violation" of the laws governing psychology. Board member Richard Applegate withheld additional information pertaining to my complaint against Dr. Connor from the rest of the Board.

The State of Indiana

The University of Louisville

Dearborn County Sheriff David Lusby- Has not returned my correspondence regarding my questions concerning where I should file a complaint regarding mail and wire fraud. Dr. Connor made many false statements in his letters to me and the court. Dr. Connor sent these documents relating to his professional services by fax and US mail. I believe the officers who tried to intimidate me in an effort to deter me from inspecting public records in the Dearborn County Courthouse are part of Sheriff Lusby's force as well. The video of the harassing behavior is can be seen on YouTube

Dearborn County Prosecutor Aaron Negangard- Initiated an investigation of me based on an unnamed lawyer, according to Special Crimes Unit Detective Mike Kreinhop. The Dearborn County Special Crimes Unit apparently wanted me for questioning but would not give me any specifics into what the investigation was about or who made the complaint. When I declined to being questioned because they would not specify the scope of the investigation or give me an explanation why they could only talk to me in person, the investigation apparently went away.

(R)State Representative Johnny Nugent- Senator Nugent's office contacted me on September 14, 2009 and informed me that they were going to contact the Prosecutor and Social Services to get their opinion. The Prosecutor initiated a "secret" investigation of me a few weeks later and I have not heard from Senator Nugent's office since.

Norb Ryan, ADA coordinator for the Commonwealth of Kentucky- Mr. Ryan responded in a prompt and courteous fashion, however Mr. Ryan stated his office did not have jurisdiction over the matter because it concerned an Indiana Court. Mr. Ryan was very receptive and gave me a few suggestions of what I may be able to do in Indiana. Dr. Connor was not licensed in the state of Indiana and the Indiana trial court would not compel Dr. Connor to release the file because Dr. Connor was in Kentucky. Dr. Connor has refused to comply with subpoenas outside of Kentucky. It appears that no state is responsible for the conduct of Dr. Edward J Connor.

The Catholic Archdiocese of Cincinnati- My oldest daughter is a kindergarten student at one of the Catholic schools in Cincinnati, Ohio. The school's policy pertaining to the release of school records is, if there is no protective order stating otherwise, the non-custodial parent is entitled to the child's student records. There is no such order. I received two progress reports. Assistant Superintendent Mary Henninger stated there was no other information to give. I guess they do not keep medical or contact information for students in the Cincinnati Catholic School System. Rather than give me a reason for not providing me with my child's records, Mary Henninger and the Catholic Archdiocese of Cincinnati resorted to lying. Not very Christian of them.

This list will grow as I will continue to contact people to help bring awareness how children are allowed to be abused by the people and organizations who we believe we can trust. It is apparent that Dr. Connor has fallen through the cracks of authority and only public awareness will help protect other children.

New name, same Dad

The new website is going to have a new name that is shorter and easier to remember. www.DanHelpsKids.com. It's hard enough for children who are caught up in divorces. They don't need to be punished by the Courts.

Share Your Story

If you want to speak out about a bad judge or custody evaluator, feel free to do it here. Don't feel obligated to leave your name as it may and probably will be used against you in court. I want to take the fear out of speaking up. Parents should not be bullied into silence. If we do not share our stories we will never be able to find out how bad the family court system is. I am not affiliated with any business relating to the family court system and I am not selling anything. I am just a loving father that wants to put an end to children being abused in the family courts. Leave your stories in the comment section below. If your want to vent or have any questions about some of the family court "professionals" in the Greater Cincinnati Area, feel free to contact me at dan@dadsfamilycourtexperience.com. I'm just here to help people speak out. Thanks for stopping by.

Thank you Sheriff Grills

Hats off to the Sheriff of Ripley County, Thomas Grills. I sent out a packet of information to Sheriffs’ Departments and Prosecutors’ offices of Dearborn and Ripley County to let them know about Dr. Edward J. Connor providing psychological services to the County Courts while not being licensed to practice psychology by the State of Indiana. Sheriff Grills spoke with me for twenty minutes about my concerns with Dr. Connor and the family court system.

I don’t know what Sheriff Grills will do or can do but at least he demonstrated his professionalism in contacting a concerned citizen about an issue, unlike the other officials who received the information. Thanks Sheriff Grills.
